In the course of using this website or availing the products and services vide the online application forms and questionnaires, The South Indian Bank Ltd. and its Affiliates may become privy to the personal information of its customers, including information that is of a confidential nature.
The South Indian Bank Ltd. is strongly committed to protecting the privacy of its customers and has taken all necessary and reasonable measures to protect the confidentiality of the customer information and its transmission through the world wide web and it shall not be held liable for disclosure of the confidential information when in accordance with this Privacy Commitment or in terms of the agreements, if any, with the Customers.
The South Indian Bank Ltd. endeavours to safeguard and ensure the security of the information provided by the Customer. The South Indian Bank Ltd. uses 128-bit and 256-bit encryption, for the transmission of the information, which is currently the permitted level of encryption in India. When the information provided by the Customers is not transmitted through this encryption, the Customers' system (if configured accordingly) will display an appropriate message ensuring the best level of secrecy for the Customers' information.
The Customer would be required to cooperate with The South Indian Bank Ltd. in order to ensure the security of the information, and it is recommended that the Customers necessarily choose their passwords carefully such that no unauthorized access is made by a third party. To make the password complex and difficult for others to guess, the Customers should use combination of alphabets, numbers and special characters (like !, @, #, $ etc.). The Customers should undertake not to disclose their password, client ID, client secret or any other API related information to anyone or keep any written or other record of the password such that a third party could access it.
The South Indian Bank Ltd. undertakes not to disclose the information provided by the Customers to any person, unless such action is necessary to: Conform to legal requirements or comply with legal process; Protect and defend The South Indian Bank Ltd.'s or its Affiliates' rights, interests or property; Enforce the terms and conditions of the products or services; or Act to protect the interests of The South Indian Bank Ltd., its Affiliates, or its members, constituents or of other persons.
The Customers shall not disclose to any other person, in any manner whatsoever, any information relating to The South Indian Bank Ltd. or its Affiliates of a confidential nature obtained in the course of availing the services through the website. Failure to comply with this obligation shall be deemed a serious breach of the terms herein and shall entitle The South Indian Bank Ltd. or its Affiliates to terminate the services, without prejudice to any damages, to which the customer may be entitled otherwise. The Customer shall not disclose any information regarding the API.
The South Indian Bank Ltd. will limit the collection and use of customer information only on a need-to-know basis to deliver better service to the customers. The South Indian Bank Ltd. may use and share the information provided by the Customers with its Affiliates and third parties for providing services and any service-related activities such as collecting subscription fees for such services, and notifying or contacting the Customers regarding any problem with, or the expiration of, such services. In this regard, it may be necessary to disclose the customer information to one or more agents and contractors of The South Indian Bank Ltd. and their sub-contractors, but such agents, contractors, and sub-contractors will be required to agree to use the information obtained from The South Indian Bank Ltd. only for these purposes.
The Customer authorizes The South Indian Bank Ltd. to exchange, share, part with all information related to the details and transaction history of the Customers to its Affiliates / banks / financial institutions / credit bureaus / agencies/participation in any telecommunication or electronic clearing network as may be required by law, customary practice, credit reporting, statistical analysis and credit scoring, verification or risk management and shall not hold The South Indian Bank Ltd. liable for use or disclosure of this information.
As API Banking is an exclusive property of the Bank, the terms of this agreement or its operational guidelines should not be disclosed to any third party, except as may be required by law or as required in by regulatory bodies and discharge of the obligations under this agreement.
The Customer shall allow the Bank to periodically audit, with reasonable prior notice, and conduct system testing to ensure adherences to the guidelines, notifications, circulars, master directions, etc. issued by the RBI in relation to API Banking, in accordance with scope mutually agreed between the Parties.
The customer agrees to choose the most convenient mode of API Banking and need to meet all the pre-requisites for the integration.
All information, data, procedures, documents, protocols etc. exchanged between the Bank and the Corporate should not be divulged, passed on, given or handed over to a third-party without mutual consent.
The Customer, Corporate agrees and undertakes to indemnify the Bank and hold the Bank harmless and indemnified at all time from and against all actions, suit proceedings, claims liabilities, penalties, demands and costs however arising directly or indirectly as a result of any breach or non-performance by the Corporate of its obligations under any agreement entered into between the remitter and the Corporate or any reasons whatsoever not directly attributable to the Bank.
The Bank may suspend or cancel the facility granted to the Corporate, Customer, if at any time continuance of such facility becomes unlawful or contrary to the instructions or directives issued by the Reserve Bank of India or Government of India or it’s agency subject to notifying Corporate with the same. that event, the Bank shall not be under any obligation to substantiate its judgment nor shall the Bank be under any obligation to indemnify the Corporate from any damages, loss or consequences whatsoever which may arise as a result of the Bank’s decision to suspend or hold in abeyance the facility granted by the Bank.
The Bank may, if need be, provide the Corporate with certain personal data or sensitive personal data or information (collectively “Personal Information”) relating to an individual/ customer of the Bank in accordance with the applicable laws, including the applicable data protection laws which may be amended from time to time. The Corporate shall use or otherwise process (collectively, “Process/Processing”) the Personal Information in accordance with the following
a) The Corporate hereby agrees to abide by all the requirements under all applicable laws, including the applicable data protection laws;
b) The Corporate hereby agree to abide by all instructions, documents and policies that may be issued to the Service Provider by the Bank with regard to the Processing of Personal Information; and
c) The Corporate hereby represent that it has implemented technical and organizational security measures of such standard as prescribed under any applicable laws, regulations, rules etc in force, to protect the Personal Information against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access and against all other unlawful forms of Processing.
